Terms of Service

The ground rules for clubs, coaches, parents and helpers using Keep Stats.

Who we are

Keep Stats is operated by Westvold Development, LLC (westvold.com). In these terms, "we", "us" and "our" mean Westvold Development, LLC. "You" means the person using Keep Stats and, for a club, the club or organization they act for. If you accept these terms for a club, school or league, you confirm that you have the authority to do so.

Using Keep Stats

Keep Stats is for tracking soccer stats live from the sideline: rosters, schedules, live game stats, game summaries and season totals. By creating an account or using Keep Stats, you agree to these terms. Use the service for legitimate team stat-keeping, and keep your sign-in details secure.

You must be 18 or older to create an account.

Accounts and clubs

The person who creates a club is its owner and is responsible for it, including the coaches and staff they invite and any roster data they or their members add. An owner can make other members owners or admins.

By entering players and other people's information, you confirm that you have the right to do so. That includes any permission from parents or guardians that your league, school or the law requires. The club controls its roster and game data and decides who can see it.

Helpers and parents

Helpers keep stats for one game using a code the coach shares. They don't need an account. Coaches are responsible for the helpers they invite and the names they enter for them, and for sharing a game's code only with people they want to keep stats. A coach can remove a helper at any time. Stats a helper has already sent stay with the game.

Parents follow a team through a link or QR code a coach shares, and need a Keep Stats account. Following is read-only. Coaches can see who follows each team, remove a parent, or turn the link off or replace it at any time. Share a team's link only with the families you want to see the team's roster and stats.

Plans, payments and refunds

Every new club gets a trial: one team and one game, plus a demo team and game that don't count toward it. After the trial's game, a club needs a plan to add games or teams. We may also grant a club a plan for a set time. A plan we grant ends on the date we set, unless we extend it.

Paid plans and game passes aren't on sale yet. If you buy one, these terms apply to it. Paid plans are yearly, bought per club, and priced by the number of teams: Starter (1 team) $39, Small (up to 3 teams) $89, Standard (up to 6 teams) $149, and Club (7 or more teams) $149 plus $20 for each team over 6. Every plan includes every feature. A plan runs for a program year, from August 1 to July 31. A plan bought partway through a program year is charged a prorated amount for the rest of that year. Plans renew automatically each year on August 1 and are charged to your payment method on file until you cancel. Before renewal, the plan's team count is lowered to the number of active teams you have (at least one), so you aren't charged for teams you archived. If a renewal's price changes, we'll email the club's owners at least 30 days before it renews. Prices are in US dollars, and sales tax is added at checkout where it applies.

A game pass is a one-time $10 purchase that lets a club record one more game. Game passes bought in a program year and not yet used are credited toward a plan the club buys in that same program year. Pass credit covers only the plan's first payment, so a promotion code may leave some of it unused, and unused credit isn't carried over.

You can add teams to a plan at any time. You pay the prorated difference for the rest of the program year. Lowering the number of teams, or archiving a team, never gives a refund: an archived team frees its place for a new one. A club's first plan purchase is refundable in full within 30 days. A renewal is refundable in full until your club creates its first game of the new program year, or September 30, whichever comes first. A game pass is refundable in full until it has been used for a game or credited toward a plan, and not after. To ask for a refund, email hello@getkeepstats.com.

If you cancel, your plan runs to the end of the program year you paid for and doesn't renew. If a payment fails, your club keeps working while the payment is retried. When a plan ends and isn't renewed, whether you paid for it or we granted it, and after the trial's game, your club becomes read-only: your games, stats and history stay readable, you can still finish recording games you already created and edit rosters, and you're never locked out. You can't add new games or teams until the club has a plan again. We never delete a club's data because its plan or trial ended. Deleting your club cancels its plan at once, with no refund for the unused time, so ask for any refund you're due first.

Acceptable use

Don't misuse Keep Stats. That includes trying to access another club's data, interfering with the service or other clubs' games, uploading anything unlawful or abusive (including in player, team or opponent names), sharing a club's access or a helper code to let someone tamper with stats, or reselling access without our permission.

Availability

We work to keep stat-keeping reliable on game day, including when phones lose signal: stats are saved on the device first and upload when the connection is back. Keep Stats is provided "as is" and "as available", and we don't guarantee uninterrupted or error-free service. Keep Stats is a record-keeping tool. Stats are only as accurate as what is tapped, and they aren't official league records unless your league says so.

To the fullest extent the law allows, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement.

Limitation of liability

To the fullest extent the law allows, we aren't liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill, arising from your use of Keep Stats or these terms. Our total liability for all claims about Keep Stats is limited to the greater of what your club paid us for Keep Stats in the 12 months before the claim, or $100.

Some places don't allow these limits, so they may not all apply to you. Nothing in these terms limits liability that the law doesn't allow to be limited.

If someone makes a claim against us because of information you entered without the right to, or because you broke these terms, you agree to cover our reasonable losses and costs from that claim, including legal fees.

Governing law

These terms are governed by the laws of the State of Ohio, without regard to its conflict-of-law rules. Any dispute will be heard in the state or federal courts located in Ohio, and you and we consent to their jurisdiction, except that either of us may bring a claim in small-claims court.

Ending your use

You can stop using Keep Stats and delete your account or your club at any time from the app. We may suspend or end access for a serious or repeated breach of these terms. If we stop offering Keep Stats, we'll tell club owners by email in advance and refund the unused part of any paid plan. When an account or club is deleted, its data is deleted as described in our Privacy Policy.

Changes to these terms

We may update these terms as Keep Stats changes. We'll tell club owners about material changes by email before they take effect. Continuing to use Keep Stats after an update means you accept the revised terms.
